[802SEC] Question about non-technical electronic ballots
Dear EC,
I have a question related to WG non-technical electronic ballots.
What are the rules governing these?
The WG P&P states:
7.2 Voting Between Meetings
At the discretion of the Chair, the Working Group shall be allowed to
conduct votes between
meetings by the use of a letter or electronic ballot. If such actions
are to be taken, they shall
follow the rules of IEEE Bylaw I-300.4(4).
The cited bylaw states:
Unless otherwise restricted by statute, the Certificate of Incorporation
of the corporation or these bylaws, any action required or permitted to
be taken at a meeting of any board or committee ... with the exception
of standards-developing committees of the IEEE Standards Association, ....
For standards-developing committees within the IEEE Standards
Association, unless a more restrictive requirement is specified in the
governing documents of the committee, majority consent of those
participating provided a majority of the voting members on the committee
respond, shall be required to approve an action taken without a meeting.
The consent, which sets forth the action, shall be signed, or
acknowledged via e-mail. If written, the consent must be executed by the
member by signing such consent or causing his or her signature to be
affixed to such consent by any reasonable means including, but not
limited to, facsimile signature. If electronic, the transmission of the
consent must be sent by electronic mail and set forth, or be submitted
with, information from which it can be reasonably determined that the
transmission was authorized by the board or committee member. The action
and written confirmations shall be filed with the minutes of the
proceedings of the board or committee.
My interpretation of this bylaw is that:
1. We can make decisions by email.
2. No provision is made for voting electronically, except by email.
However, use of ePoll or other electronic balloting tools can be
reasonably interpreted as satisfying the " it can be reasonably
determined that the transmission was authorized by the board or
committee member".
3. Approval is required by a majority of those responding, and a
response ratio of >50% is required.
And in 11.0:
The response time for a Working Group letter ballot on a draft shall be
at least thirty days.
However, for recirculation ballots the response time shall be at least
fifteen days.
The 802 OM states: (presumably for 802 EC operation)
4.1.2:
The minimum duration of an electronic ballot shall be 10 days. For
urgent matters once
sufficient response is received to clearly decide a matter, the ballot
may be closed early. This
allows a decision to be reached in less than 10 days.
The SASB OM states: (for sponsor ballot operation)
5.4.3.1 Ballot term
Each ballot in the standards balloting process shall close at 23:59 UTC-12
on the closing date specified on the ballot. The length of the ballot
and associated recirculations is set by the Sponsor. The initial ballot
term shall be at least 30 days in duration. The recirculation ballot
term shall be at least 10 days in duration.
There appear to be no rules describing the duration of a WG
non-technical electronic ballot.
Does anybody disagree?
Absent such rules, I propose it would be helpful to add them to align
with the sponsor operation.
(i.e. 10 days; and possibly an early close option).
